Purpose<\/strong><\/p>\n\n\n\n This policy describes the circumstances under which Âé¶¹ÊÓÆµ (MTSU or University) may apply the contested case hearing provisions of the Uniform Administrative Procedures Act (UAPA), T.C.A. \u00a7\u00a7 4-5-101 et. seq. and the procedures for UAPA hearings.<\/p>\n\n\n\n II. Scope<\/strong><\/p>\n\n\n\n The contested case procedures set forth in the UAPA may be applicable in all cases in which the legal rights, duties, and privileges of a party are required by any statute or constitutional provision to be determined by an agency after an opportunity for a hearing. These procedures may also apply when MTSU policy provides that a hearing take place pursuant to the provisions of the UAPA.<\/p>\n\n\n\n III. Authority of the President<\/strong><\/p>\n\n\n\n IV. Selection of Administrative Judge, Hearing Officer, or Hearing Committee<\/strong><\/p>\n\n\n\n V. Hearing Procedures<\/strong><\/p>\n\n\n\n Unless specifically stated in another policy or applicable law to the contrary, the hearing procedures set forth in T.C.A. \u00a7\u00a7 4-5-301, et. seq.<\/em> and Tenn. Comp. R. & Regs. 1360.04.01.01 et seq. shall apply to cases heard pursuant to this policy.<\/p>\n\n\n\n VI. Suspensions Pending a Contested Case Hearing<\/strong><\/p>\n\n\n\n The President shall have authority to suspend a student or employee pending a contested case hearing. Grounds and procedures for interim suspension of a student are set forth in\u00a0Policy 540 Student Conduct<\/a>.
